Institution Subscription Purchase Terms and Conditions

These Terms and Conditions (“Terms”) govern the purchase of 1-Year Institution Subscriptions to the Anisthesia educational app (“App”) from Trail 77 Anesthesia. (“Provider,” “we,” or “us”) by accredited educational institutions, nurse anesthesia programs, or their authorized representatives (“Program” or “you”). By completing a purchase on our website, you agree to these Terms on behalf of your institution.

1. The Service

  • We offer 1-Year Subscriptions that provide full access to the Anisthesia App for your student cohort.

  • Upon receipt of full payment, we will generate and deliver unique, single-use promo codes granting each enrolled student 1 year of full access to the App (subject to the number of students covered by your selected tier).

  • Access includes all current and future educational content, animations, quizzes, procedural guides, and features available in the App during the subscription term.

  • Promo codes are delivered to the designated program contact within 7 business days of payment confirmation, along with instructions for distribution to students.

2. Pricing and Payment

  • Pricing is based on current model. You may not exceed the maximum number of students for your tier without purchasing an additional or upgraded subscription.

  • All payments are due in full at the time of purchase via the available payment methods on our site.

  • Prices are in U.S. Dollars and do not include any applicable taxes, which you are responsible for.

  • We reserve the right to update pricing for future purchases; current pricing applies to your order at the time of checkout.

3. License Grant

  • We grant you and your students a limited, non-exclusive, non-transferable, revocable license to access and use the App solely for educational purposes during the 1-year term.

  • Students may use the App on their personal devices via the Apple App Store or Google Play.

  • You may not sublicense, resell, distribute, or commercially exploit the App or its content outside of your enrolled cohort.

4. Student Data and Privacy

  • After payment, you will provide a list of student emails (and any other required details) via our secure form or designated method.

  • We will use this information solely to generate and deliver promo codes and to provide support related to the subscription.

  • We handle all personal data in accordance with our Privacy Policy and applicable laws, including FERPA where relevant. You represent that you have obtained all necessary consents or permissions to share student information with us.

  • We implement reasonable security measures to protect the data. However, we are not liable for any breaches resulting from your transmission methods or student actions.

5. Intellectual Property

  • All content, animations, quizzes, designs, and technology in the Anisthesia App are owned by or licensed to the Provider and protected by copyright, trademark, and other intellectual property laws.

  • You and your students acquire no ownership rights in the App or its content.

6. Warranties and Disclaimers

  • We warrant that the App will substantially perform as described on our website during the subscription term.

  • THE APP IS PROVIDED “AS IS” except for the limited warranty above. We do not guarantee specific learning outcomes, exam pass rates, or uninterrupted access (subject to reasonable maintenance windows).

  • We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

  • To the fullest extent permitted by law, our total liability arising out of or related to this agreement shall not exceed the amount paid by you for the specific cohort subscription.

  • We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or educational opportunities.

8. Termination and Refunds

  • The subscription is non-refundable except in cases of material breach by us that is not cured within 30 days of notice.

  • We may terminate access for violation of these Terms, including unauthorized distribution of promo codes or misuse of the App.

  • Upon termination or expiration, student access will end, and unused promo codes become invalid.

9. General Provisions

  • Governing Law: These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in Maricopa County, Arizona.

  • Entire Agreement: These Terms, together with our Privacy Policy and the purchase confirmation, constitute the entire agreement.

  • Amendments: We may update these Terms; continued use after changes constitutes acceptance.

  • Severability: If any provision is held invalid, the remainder remains in effect.

By purchasing a Cohort Subscription, you confirm that you are authorized to bind your institution to these Terms and that your institution agrees to comply with them.
